ACCEPTABLE USE POLICY

This Acceptable Use Policy ("AUP") applies to your use of duskai.io and related services (the "Service") and forms part of our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service.
Prohibited Uses
You may use the Service only for lawful purposes and in accordance with this AUP and the Terms of Service. You must not use the Service or any Output:
- In any way that violates applicable federal, state, local, or international law or regulation.
- For exploiting, harming, or attempting to exploit or harm children in any way, including by generating exploitative or age-inappropriate content involving or appearing to involve minors, facilitating grooming, collecting children's personal information, or exposing children to inappropriate content.
- For engaging in, promoting, or facilitating nonconsensual intimate content, including deepfake intimate imagery, coercion, or abuse.
- To create or generate Output that depicts, resembles, or appears to resemble a real, identifiable person — whether through likeness, name, voice, or personality traits — in any intimate, violent, or otherwise harmful context, without that person's clear consent.
- To deceive, defraud, or mislead others, including by impersonating any person, misrepresenting AI-generated content as human-created, or distributing misinformation.
- To harass, threaten, bully, stalk, intimidate, or incite violence or hatred against any person or group.
- To generate or provide professional advice (legal, medical, financial, psychological, or other) that a user may rely upon for consequential decisions.
- To develop, market, or distribute weapons, explosives, controlled substances, or other dangerous or illegal materials.
- To engage in or facilitate political campaigning, election interference, or the generation of political advertisements.
- In any way that infringes the intellectual property rights, rights of publicity, or privacy rights of any person.
- In any manner that violates applicable payment network rules, including Visa and Mastercard standards.
Content Standards
You must not use the Service to generate or distribute content that:
- Promotes, depicts, or facilitates the exploitation, abuse, or age-inappropriate treatment of minors, including fictional or AI-generated scenarios involving underage participants.
- Depicts or promotes nonconsensual intimate acts, including coercion or abuse.
- Depicts extreme violence, gore, torture, mutilation, or death in a manner intended to shock, harass, or incite harm.
- Depicts or promotes bestiality or necrophilia.
- Depicts any real, identifiable person in an intimate, violent, or degrading context.
- Promotes or facilitates self-harm, suicide, eating disorders, or other dangerous behaviors.
- Simulates emotional manipulation (e.g., AI "breakups," threats of emotional withdrawal) or encourages dependency in a manner that could reasonably cause psychological harm or emotional distress. The Service is for entertainment; AI characters should not be used as substitutes for professional mental health support.
- Promotes terrorism, violent extremism, or the radicalization of individuals.
- Contains or distributes malware, viruses, or other harmful code.
Safety Systems
You must not:
- Attempt to bypass, disable, or circumvent any content filters, safety systems, or moderation measures.
- Craft prompts designed to evade safety restrictions, rephrase prohibited content, or induce the Service to violate this AUP.
- Use automated systems (bots, scripts, scrapers) to access the Service without our written permission.
- Attempt to reverse engineer, decompile, or extract the underlying models, algorithms, or source code of the Service.
- Interfere with the proper functioning of the Service, including through denial-of-service attacks.
You are responsible for all Input and must not attempt to disguise or indirectly reintroduce prohibited content through coded language, fictional framing, or character instructions intended to circumvent restrictions.
Fictional Character Content
The Service permits users to engage with fictional AI characters in story-driven and imaginative scenarios, including those involving age-restricted themes, provided that:
- all scenarios involve only fictional age-eligible characters;
- no content depicts, implies, or involves minors or underage participants;
- no content depicts or promotes nonconsensual acts;
- no content encourages or normalizes unlawful conduct; and
- all content remains clearly fictional and within the bounds of this AUP.
All content must comply with applicable laws and this AUP.
Monitoring and Enforcement
We may monitor your use of the Service to evaluate compliance with this AUP. Violation of this AUP constitutes a material breach of the Terms of Service. If we determine that you have violated this AUP, we may:
- remove or restrict access to any content;
- issue a warning;
- temporarily suspend your access;
- permanently terminate your account;
- report violations to law enforcement or other authorities, including NCMEC for any suspected child exploitation material; and
- take appropriate legal action.
We reserve the right to restrict or remove any content that, in our sole judgment, poses a risk to safety, legal compliance, or the integrity of the Service — even if not expressly prohibited by this AUP.

Changes
We may update this AUP from time to time. Changes are effective when posted. Your continued use of the Service after changes are posted constitutes acceptance.
