CANCELLATION AND REFUND POLICY

This Cancellation Policy applies to paid subscriptions and purchases made through duskai.io and related services (the "Service") operated by Dusk AI LLC ("Company," "we," "us," or "our").


How to Cancel Your Subscription

You may cancel your subscription at any time through one of the following methods:

  • In-app: Navigate to Settings > Subscription and select "Cancel Subscription."
  • Email: Send a cancellation request to [email protected] from the email address associated with your account.
  • Google Play / App Store: If you subscribed through Google Play or the Apple App Store, you must cancel through the respective platform's subscription management settings. We cannot cancel subscriptions purchased through third-party app stores on your behalf.

Effect of Cancellation

When you cancel:

  • Your subscription remains active until the end of the current billing period.
  • You retain access to all paid features until the billing period ends.
  • After the billing period ends, your account will revert to the free tier.
  • Your account data (conversations, characters, Memories) will be retained and accessible under the free tier unless you separately request account deletion.

No partial refunds are issued for unused time within a billing period.


Refund Policy

All payments are final and non-refundable, except:

  • where required by applicable law;
  • where we determine, at our sole discretion, that a refund is warranted due to a technical issue or billing error; or
  • where you are exercising a legal right of withdrawal (see EU Consumer Rights below).

Refund requests should be submitted to [email protected] with your account email and a description of the issue. We will respond within 7 business days.

For subscriptions purchased through Google Play or the Apple App Store, refund requests must be directed to the respective platform, as those transactions are subject to their refund policies.


EU Consumer Right of Withdrawal

If you are a consumer in the European Union, you have a legal right to withdraw from a purchase within 14 days of the transaction date, without giving any reason.

However, by purchasing a subscription and accessing or using the Service, you expressly consent to immediate performance of the digital content service. You acknowledge that once you begin using the Service, you lose your right of withdrawal.

If you wish to exercise your right of withdrawal before using the Service, contact us at [email protected] within 14 days of purchase. We will process a full refund within 14 days using the same payment method you used for the original transaction.


Account Deletion

Cancelling your subscription does not delete your account. If you wish to delete your account and all associated data, you may:

  • Send a deletion request to [email protected] from the email associated with your account; or
  • Use the account deletion option in Settings (when available).

Upon receiving a valid deletion request, we will delete your account and all associated personal data within 30 days, except where retention is required by law. This action is permanent and cannot be undone.


Chargebacks and Disputes

Filing a chargeback or payment dispute without first contacting us may result in immediate suspension of your account. We encourage you to contact [email protected] to resolve billing issues before initiating a dispute with your payment provider.
