DMCA POLICY

Dusk AI LLC ("Company," "we," "us," or "our") respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.


Reporting Copyright Infringement

If you believe that content on duskai.io or related services (the "Service") infringes your copyright, you may submit a written notification to our designated DMCA agent containing:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing and information reasonably sufficient to allow us to locate it on the Service (e.g., URL, character name, description).
  4. Your contact information, including name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Response to Valid Notices

Upon receiving a valid DMCA takedown notice, we will:

  • promptly remove or disable access to the allegedly infringing material;
  • notify the user who posted the material that it has been removed or disabled; and
  • provide the user with information about how to submit a counter-notification.

Counter-Notification

If you believe your content was removed in error or based on misidentification, you may submit a counter-notification to [email protected] containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location at which it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the United States District Court for the Western District of Texas), and that you will accept service of process from the person who submitted the original DMCA notice or their agent.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed material.


Repeat Infringers

It is our policy to terminate the accounts of users who are repeat infringers of copyright, in appropriate circumstances as determined by us.


Good Faith

Misrepresentation in a DMCA notice or counter-notification may result in liability for damages, including costs and attorneys' fees. If you are not sure whether material infringes your copyright, consider seeking legal advice before submitting a notice.
