COMPLAINTS POLICY

This Complaints Policy describes how to report content you believe is illegal or violates our policies on duskai.io and related services (the "Service"), in accordance with the EU Digital Services Act (Regulation (EU) 2022/2065) and our Terms of Service and Acceptable Use Policy.


How to Report Content

If you believe any content on the Service violates applicable law, our Terms of Service, or our Acceptable Use Policy, you may submit a report by emailing [email protected] with the following information:

  1. A description of the content you are reporting.
  2. The location of the content on the Service (e.g., URL, character name, or other identifying details sufficient for us to locate it).
  3. An explanation of why you believe the content is illegal or violates our policies.
  4. Your contact information (email address).
  5. A statement that the information in the report is accurate and provided in good faith.

For copyright infringement claims, please use the procedure described in our DMCA Policy.


How We Process Reports

Upon receiving a complete report, we will:

  • Acknowledge receipt — we will confirm receipt of your report promptly.
  • Review the content — we will assess the reported content against applicable law, our Terms of Service, and our Acceptable Use Policy.
  • Take action — if we determine the content violates applicable law or our policies, we will take appropriate action, which may include removing or restricting access to the content, issuing warnings, suspending accounts, or reporting to authorities.
  • Notify the reporter — we will inform you of our decision and the basis for it in a timely manner.
  • Notify the affected user — where content is removed or an account is restricted, we will notify the affected user of the action taken, the reasons for it, and how to appeal (see our Appeals Policy below).

We aim to process reports within a reasonable timeframe. Reports involving suspected child exploitation or imminent harm will be prioritized and may be reported to law enforcement authorities.


Appeals

If your content has been removed or your account has been suspended or restricted, and you believe the action was taken in error, you may appeal by contacting [email protected] with:

  1. Your account identifier (username or email).
  2. A description of the action taken.
  3. Your reasons for believing the action was in error.

We will review your appeal and provide a reasoned decision. If you are located in the European Union, you retain the right to refer the matter to an out-of-court dispute settlement body or to the competent courts of your Member State.


EU-Specific Provisions

If you are located in the European Union:

  • This Complaints Policy implements the notice and action mechanism required by Articles 16 and 20 of the Digital Services Act (DSA).
  • You will receive a reasoned decision for any action taken on your content or account, including the legal or policy basis for the decision.
  • You have the right to appeal content moderation decisions (Article 17 DSA).
  • You may also contact a certified out-of-court dispute settlement body for resolution (Article 21 DSA).

If you encounter content that involves imminent risk to life or safety, or suspected child exploitation, please report it immediately to:
